What The Offer Is

The first 10 eligible professionals in each published Launch Market may receive 90 days of ProByName Solo access beginning when their approved account is activated. There is no cash, gift card, purchase, payment, drawing, contest, or game of chance.

No payment card is required, and none is taken. ProByName cannot currently accept payment from anyone — there is no paid plan available for purchase. The 90 days do not automatically become a paid subscription, and nothing is charged when they end.

The founding price. A professional who activates under these terms may, if and when a paid Solo plan becomes available, choose it at $9 per month for as long as they keep it — rather than the ordinary price, which is currently intended to be $24 per month. That is a right this professional holds, not a charge and not a commitment to buy. If ProByName never offers a paid plan, nothing is owed by anyone.

Who May Participate

An applicant must be at least 18, operate or be authorized to act for an independent service business, actually serve the Launch Market selected on the application, provide accurate information, and be legally permitted to offer each listed service. Applications remain open nationwide even when an applicant does not select a Launch Market.

One offer is available per person and per business under common ownership or control. Employees, contractors administering this offer, and members of the operator's immediate household are not eligible. The offer is void where prohibited.

How Markets And Order Work

A Launch Market is a published U.S. Metropolitan Statistical Area. ProByName publishes up to five of the largest metro areas touching each state or the District of Columbia using U.S. Census Bureau population estimates. A metro that crosses jurisdiction lines is one market with one shared pool of 10 places.

A complete application that requests a Launch Market receives the next permanent queue number for that market when submission is committed. The first 10 receive provisional places. Queue number, submission time, and application identifier provide the audit record and are not silently changed. An applicant outside a published market may still apply but is not promised the 90-day offer.

Review And Activation

1. Submit a complete application and accurate public-profile information.
2. Pass application and profile review.
3. Activate the private account invitation within seven days after it is issued.

No completed job, scheduled service, customer transaction, review, testimonial, referral, or social post is required. A provisional place is not final approval. If a place holder is ineligible, declines, withdraws, misses the activation deadline, or submits duplicate or fabricated information, the place may be released to the next eligible applicant in the original market queue.

Records And Changes

ProByName records the accepted terms version, market, queue number, provisional place, decision, activation, and access dates. An applicant may request their recorded status by emailing dane@probyname.com.

A denial or released place must have a recorded reason. Material changes apply prospectively and will not remove access already granted under an accepted terms version, except to correct fraud, illegality, or a clear processing error.

Earlier versions of these terms remain readable at their own addresses, and a right accepted under one of them stays governed by that version. See the list at the end of this page.

No Endorsement Requirement

The free access is not payment for praise or promotion. Receiving it does not require a favorable review, testimonial, social post, referral, recommendation, or permission to use the recipient's name in advertising.

What ProByName Does Not Promise

The service is provided “as is” and “as available”, without warranties of any kind, express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, title, or non-infringement. ProByName does not warrant that the service will be uninterrupted, timely, secure, or error-free, and does not promise any customer, request, booking, revenue, or result.

This is a product in active development. Features may change or be withdrawn. Access granted under an accepted version of these terms is not removed by a later change.

Limits On Responsibility

To the fullest extent permitted by law, PROBYNAME LLC is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity arising out of or relating to this offer or the service, whether based in contract, tort, negligence, strict liability, or otherwise, and even if it was told such damages were possible.

Total liability for all claims relating to this offer is limited to the greater of the amount the professional paid PROBYNAME LLC in the twelve months before the claim, or one hundred US dollars. Because this offer takes no payment, that will ordinarily be one hundred dollars.

ProByName is not liable for the acts, omissions, work, conduct, or safety of any professional or any customer. Some jurisdictions do not allow certain limitations, so parts of this section may not apply.

Governing Law And Where Disputes Go

These terms are governed by the laws of the State of Louisiana, without regard to its conflict-of-laws rules. Any dispute relating to them will be brought exclusively in the state or federal courts located in Lafayette Parish, Louisiana, and the professional consents to that jurisdiction and venue.

Events Outside Anyone's Control

PROBYNAME LLC is not liable for failure or delay caused by something beyond its reasonable control, including an outage at an infrastructure provider, network failure, natural disaster, severe weather, or government action.

If ProByName Stops

If the service or this offer is discontinued, PROBYNAME LLC will give at least 30 days' notice to the email address on the account and keep record export available throughout that period. Records are not held hostage, and no payment is required to release them.

Earlier Versions

• launch-offer-2026-08-14 — effective 08-14-2026. Superseded on August 15, 2026. PROBYNAME LLC was formed on August 14, 2026 and became the counterparty, and the access period became 90 days. No application had been submitted under this version, so no accepted right was affected.
• founding-market-2026-08-10 — effective 08-10-2026. The historical Founding Market terms, superseded by the Launch Offer on August 14, 2026. Rights accepted under this version remain governed by it and are never rewritten as acceptance of a later one.
